Terms of Service

Acceptance of terms
By accessing or using Capsule ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
These terms apply to all users of the Service, including the Capsule CLI agent, the web dashboard, and any associated APIs.
Description of service
Capsule is a database backup service. It consists of a command-line agent you install on your server and a web dashboard hosted by us. The agent performs local database dumps, encrypts the output, and uploads ciphertext to Capsule's cloud storage. The dashboard lets you view backup history, manage connections, and configure schedules.
We reserve the right to modify or discontinue any part of the Service at any time with reasonable notice.
Accounts
Registration: You must provide a valid email address and keep your account credentials secure. You are responsible for all activity that occurs under your account.
One account per user: Each account is for a single user or organisation. You may not share your account or allow others to access it on your behalf without explicit permission from us.
Age requirement: You must be at least 16 years old to use the Service. By registering, you confirm that you meet this requirement.
Acceptable use
You agree to use the Service only for lawful purposes and only to back up databases that you own or have explicit authorisation to back up. You must not:
Abuse the infrastructure: Attempt to exceed rate limits, reverse-engineer the Service, introduce malware, or interfere with other users' access.
Back up unauthorised data: Use Capsule to back up databases belonging to third parties without their knowledge and consent.
Resell the Service: Resell, sublicense, or offer Capsule as a white-labelled product without a written agreement with us.
Subscription and billing
Plans: Capsule offers a Free plan and paid plans (Solo, Pro, Team). Paid plans are billed monthly or annually in advance.
Payment processor: All payments are processed by Stripe. We never store your card number or banking details.
Refunds: We do not provide refunds for partial billing periods. If you downgrade or cancel mid-cycle, your plan remains active until the end of the current period.
Plan limits: Each plan has storage, retention, and connection limits. Exceeding your plan limits may result in backups being paused until you upgrade or free up space.
Data and backups
You retain full ownership of your data. Capsule stores only AES-256-GCM encrypted ciphertext — we are cryptographically unable to read the contents of your backups. Your encryption key is derived locally on your server and never transmitted to us.
While we take reasonable steps to ensure durability, Capsule is a backup service — not a primary data store. You are responsible for verifying that your backups complete successfully and for maintaining any additional copies your situation requires.
Retention and cancellation
Active accounts: Backup files are retained according to your plan: 7 days on Free, 90 days on Solo, 1 year on Pro, 3 years on Team.
Cancellation: You may cancel your subscription at any time from the dashboard. After cancellation, your account enters a 30-day grace period during which you can export your backup files.
Deletion: After the 30-day grace period, all encrypted backup files and account data are permanently deleted from our servers. This action cannot be undone.
Service availability
We aim for high availability but do not guarantee uninterrupted access to the Service. Scheduled maintenance, infrastructure incidents, or events outside our control may cause temporary outages.
To the maximum extent permitted by applicable law, Capsule is not liable for any data loss, missed backups, or damages arising from service unavailability. Backups are a safety net — you should independently verify that critical backups have completed before relying on them.
Termination
We may suspend or terminate your account if you violate these terms, engage in fraudulent activity, or use the Service in a way that harms other users or our infrastructure.
Where possible, we will notify you before taking action and give you an opportunity to resolve the issue. In cases of serious abuse we reserve the right to act immediately without notice.
Changes to these terms
We will notify you by email at least 14 days before making material changes to these terms. Continued use of the Service after the effective date of any changes constitutes acceptance of the new terms.
The effective date at the top of this page will always reflect the most recent revision.
